In a written arraignment Tuesday, July 29, Terry Lee Schott entered a plea of not guilty and waived his right to a speedy trial on charges of sexual assault of a 15-year-old female.
Schott, 49, was arrested on June 15 on charges of sexual abuse in the third degree, a class C felony. The charges stem from items seized during the execution of a search warrant at 202 E. Railroad St., Fredericksburg, on June 15 by the Chickasaw County Sheriff’s office.
An order of protection was filed on behalf of the victim on June 17.
According to court documents, depositions have been taken from several Fredericksburg residents and county deputies which defense attorney Jennifer Schwickerath has requested. Schott has stated in court documents that his address is 18129 250th St., Hawkeye.
A final pretrial conference has been set for 10 a.m. Sept. 16 when plea negotiations will be completed. Court documents state, the defendant can enter a guilty plea at that time. The court may impose a deadline for court approval of any plea agreement. All timely filed non-evidentiary pending motions will be ruled at that pretrial, unless an earlier hearing date is requested or the motion is ordered to be heard by the trial judge.
A jury trial has been scheduled for 9 a.m. Sept. 24. Bond was set at $10,000. Schott remains in the custody of the Chickasaw County Sheriff’s Office.
Court records also state Schott agrees that “the name shown on the indictment/trial information is my true name. I have been advised and understand that I am now precluded from objecting to the indictment/trial information upon the ground I am improperly named.”
Schott also agreed that he has had sufficient time to discuss his case with his attorney and waives any further time in which to enter a plea.
